Note from Fred Regarding Exam Changes

Hello PMN Community,

As some of you may know, in a startling move on Friday, May 15, 2015 –  just three weeks before the June 6th exam – LSU- OAE  CHANGED the exam format by eliminating the written part of the scenario component.

At first blush, you may think they have made the test easier by doing this. Do not be misled. You may also think that if you have spent significant time working my scenario workbook and practicing writing exams, you have not spent your time well. Do not be misled. The overwhelming impression you should take from this change is that though you may now not be required to perform the skill of actually writing a document based on scenario facts, your knowledge and understanding of what the “content of act” requirements and “statutory directives” are for all types of notarial documents, is just as important as ever.

Nothing has changed about the content of the test, just the method.  Under “critical knowledge”, they reference conveyances and mortgage of movable or immovable property, notarial testaments and succession by affidavit plus the other documents listed on pages 584 through 587. As I have always contended in my UL classes, and with the Pass My Notary extended community, studying for critical knowledge requires you to know what makes for a valid document with legal effect so you can recognize it and thereby recognize ineffective documents. Those of you who attended the May 9 seminar still have the raw material necessary to perform competently on critical knowledge.

Left unanswered is what this change means for persons who only need to pass the written part to become a notary. I suggest you contact the Secretary of State for those answers and advise me as to what they say. I welcome your emails. You can find exam format information detailed here on the Secretary of State’s website.

Sincerely, Fred W. Davis
